The man received compensation of RM652,000


Tengku Muhamad Khazi Hakimi Ku Hussin, 34, fell in an accident on 1 December 2019 at Kilometer 53 of Jalan Kota Bharu – Kuala Krai, in Machang.

KOTA BHARU – A man who lost his left leg as a result of falling into a flooded hole on the road in an incident two years ago received compensation of RM652,000.

Tengku Muhamad Khazi Hakimi Ku Hussin, 34, who is now permanently disabled, fell in an accident on 1 December 2019 at Kilometer 53 of Jalan Kota Bharu – Kuala Krai, in Machang.

The Kota Bharu Sessions Court which made the decision on Wednesday allowed the compensation in relation to the claim made against Roadcare Malaysia Sdn Bhd and the Malaysian government.

The decision was made by Judge Mohd Zul Zakiqudin Zulkifli.

Tengku Muhamad Khazi Hakimi was represented by advocates, Wahab Che Kob and Nor Asniza Husin.

When contacted, Asniza said that Roadcare and the Malaysian government denied the existence of potholes on the road.

“However, the court stated based on the evidence and testimony from the plaintiff’s side that the accident occurred due to a hole overflowing with water.

“It is a result of the negligence of Roadcare as a road maintenance contractor to the Malaysian government as the defendants,” he said on Thursday.

The defendant was represented by lawyers S Siva Shanker and Asmah Che Wan.
